Punitive damages may be available in your Florida truck accident case. The first type of damages, though, that you would want to recover would be your compensatory damages, which actually compensate you for your economic losses, such as medical bills and wage loss or loss of earning capacity. Punitive damages, however, are considered a punishment for a wrongful act. Generally, you have to show that the defendant intended the conduct or that they were so reckless or grossly negligent that they allowed the conduct to occur. A good example of that would be if a truck driver had been drinking before getting into the truck or even while driving the vehicle, which resulted in a car accident.
