Yes, punitive damages are available in Florida spinal injury cases. There are two general categories of damages. The first category is compensatory damages. Those damages are designed to compensate you for the injuries you sustained. The second type of damages are punitive damages. With punitive damages you have to prove that the at-fault party intended to harm you.

The other way you can get punitive damages is by proving that the at-fault party was reckless, or their conduct was grossly negligent. Once you prove that, you have made a case for punitive damages. A good example of reckless conduct would be if a person is drinking alcohol and then gets behind a wheel and causes harm or injury to another.
