Collision At Dock Kills 48 Birds

When a person deliberately tries to injure another person with a motor vehicle, it is both a crime and a potential civil lawsuit. In mid-October 2025, a commercial driver at the Port Canaveral cargo dock allegedly chose to deliberately run over a flock of shore birds resting in a parking lot. 35 died in the initial crash, with 13 more having to be euthanized due to their injuries. While obviously, birds are not people, this crash raises interesting questions about what happens when a driver chooses to injure others.

Most Accidents Are Not Intentional

Most road accident cases do not involve malice or intention to injure anyone. Rather, they are most often acts of negligence, where a driver fails to exercise the level of reasonable care required by law while operating a vehicle. In most crashes, one individual is found liable for the injuries of another, but In the event of a collision involving a commercial vehicle, both the driver and their employer can sometimes wind up on the proverbial hook.

Florida has a no-fault auto insurance system, which means that cases involving minor injuries are usually handled out of court, via insurance claims. However, if injuries are “significant and permanent,” a person is permitted to file suit against the person who allegedly caused them in court. The only caveat is that it may be prudent to wait until any criminal trial has concluded, given that anything admissible in criminal court will generally be admissible in a civil proceeding.

Potential Civil & Criminal Consequences

It was determined that the trucker at the Port Canaveral dock would have had to “step on the gas and gun it” – a clear demonstration of intent to destroy the birds, or at least a complete disregard for the welfare of these living things. In a case involving two or more human beings, a person who deliberately seeks to harm will almost certainly be charged with a crime. However, this does not mean that an injured person cannot seek damages from them as well.

As of this writing, both state and federal Fish & Wildlife Bureau authorities are seeking the commercial driver, but no confirmation of his identity has been released. Once their investigation is complete, they will submit their findings to the Brevard County Sheriff’s Office, which will determine whether criminal charges are appropriate or not. However, if you believe you have been intentionally struck by another driver, you may file a civil suit if your injuries are serious enough.
