Jacksonville Driver Dies After Vehicle Strikes Parked Tractor-Trailer

In early October 2026, a Jacksonville man was killed after striking a tractor-trailer parked on the shoulder of I-295. The tractor-trailer driver had stopped and pulled over his vehicle to assist with a disabled car in the center lane, and the man’s SUV failed to swerve to avoid it in time. While as of this writing, the family does not appear to be planning any kind of lawsuit, it might be possible for someone to do so if the facts remain the same.
Likely To Cause Fatalities
Most tractor-trailer accidents occur while both vehicles are in motion, but accidents where one vehicle strikes a stationary vehicle or object can be just as devastating. Data from the National Safety Council (NSC) estimates that around one-quarter of road fatalities result from this type of accident, which is disproportionately higher than the rate associated with two moving vehicles colliding. Part of the reason why is that a moving vehicle may crumple on impact, absorbing some of the force – in general, a large vehicle like a tractor-trailer at rest will not absorb much, creating a catastrophic impact.
While the SUV driver was unfortunately pronounced deceased not long after the initial crash, someone in a similar situation who survived such an accident might wonder if they were the victim of negligence. Florida law requires that every road user exercise ‘reasonable care’ toward other road users – not just drivers, but pedestrians and users of other conveyances. While no evidence exists that the I-295 driver was negligent, it is very plausible that another tractor-trailer driver could be in the same situation.
Are Damages Possible?
While there are many details of the I-295 accident that are not available to the public, one can say generally that negligence in Florida law is a failure to exercise reasonable care toward other road users. A failure to do so can be actionable, as long as the crash was foreseeable – that is, was it within the realm of possibility to an average person that such an accident might happen? If it was, and it can be shown that the defendant’s actions were the direct cause of injuries to the plaintiff, a person might have a case.
It is, in this case, reasonably foreseeable that one might see stopped vehicles on a Florida road, in the area of the road where disabled vehicles go to stop without impeding traffic. In addition, it is not out of the realm of possibility that other actors may have played a role in causing this crash, most notably if there was some design or manufacturing problem with the components or construction of the SUV. It is important, if you have been through this type of crash, to understand your options in terms of who might be liable for your injuries.
