Tractor-Trailer Bursts Into Flames On I-275

In early September, a tractor-trailer crashed on I-275 in Pinellas County and burst into flames, causing a serious headache for morning travelers. The Florida Highway Patrol reported that the driver allegedly “failed to negotiate a curve,” causing the vehicle to overturn, after which an apparent fuel leak caused the fire. The driver was taken to a nearby hospital with serious injuries, though luckily, no one else appeared to be injured. This is not always the case; sometimes, single-vehicle accidents can cause injuries to those not involved.
Many Invisible Causes Possible
This accident appears to have only involved the single vehicle, and it has been attributed to driver error; thus, no one else appears to be liable for the driver’s injuries. However, it is quite common for this type of accident to have more causes than one might think. For example, there might have been a mechanical defect in a part of the vehicle, and such an event would place liability on the manufacturer or maintainer of the vehicle, rather than on the driver.
This type of crash can also cause problems not only for the people in the vehicle itself, but for those around it. As one might imagine, if a vehicle bursts into flames, it could easily spread to other vehicles and things like trees or buildings if not contained quickly. While most people may think a single-vehicle accident only has one victim, one or more lawsuits still might result from the events of the crash.
Difficult, But Not Impossible
If you have been injured as a result of a single-vehicle accident involving a tractor-trailer, know that you have the right to seek compensation as long as your injuries were foreseeable, and as long as you can show that the actions (or inactions) of the defendant were the direct cause of your suffering harm. If your injuries were minor, it may be best to file a claim with your personal injury protection (PIP) insurer, but if they were significant and/or permanent, you may have a case.
Keep in mind that a PIP claim does not allow you to claim pain and suffering damages, which can add up, particularly if you suffer emotional trauma after your experience. Historically, Florida law has been reluctant to compensate people after accidents if they were not in the vehicle or struck by it, but as the law changes, you stand a better chance of recovery if the evidence is there.
