In Florida, if there is uninsured or underinsured motorist insurance available, you can collect under the following circumstances. If the driver of the vehicle or the owner of the vehicle did not have insurance, you may collect under the available uninsured motorist coverage. To collect under the underinsured motorist coverage, you must demonstrate that your damages, the harms and losses that you sustained in the crash, are of greater value than the available insurance of the at-fault parties.
