The other way you can get punitive damages is by proving that the at-fault party was reckless, or their conduct was grossly negligent. Once you prove that, you have made a case for punitive damages. A good example of reckless conduct would be if a person is drinking alcohol and then gets behind a wheel and causes harm or injury to another.
